ROYDEN ANNUAL MEETING QUESTIONS…WITH NO ANSWERS

Dear Royden Members (past and present) and Blog subscribers (associationbusters.com).
Continuing our homeowner education and advocacy efforts, here are some basic questions to ask the Royden Board Members at the upcoming Annual Meeting at Carmel Presbyterian Church, Saturday June 24 at 9:00AM.

1)WHY IS THE ROYDEN SUBDIVISIONS’ COVENANT, ARTICLE IV-COVENANT FOR MAINTENANCE ASSESSMENT, NOT BEEN USED FOR THE PAST 10 YEARS????(ATTACHMENT 1)

2)WHY HAS THERE BEEN NO 10% CONTINGENCY ($2900.00) RESERVE CREDIT BEEN GIVEN TO MEMBERS, PROSCRIBED UNDER ARTICLE IV, FOR THE PAST 10 YEARS?

3)WHY IS THE 2017-2018 ANNUAL ASSESSMENT NOT EQUAL TO ZERO $ AS PROSCRIBED BY ARTICLE IV?

4)WHY ARE LEGAL COSTS AND SOCIAL COSTS PART OF THE ANNUAL OPERATING BUDGET WHOSE “PURPOSE” IS SOLELY FO COMMON AMENITIES MAINTENANCE?????

5)WHY DOES THE 2016-2017 FINANCIAL STATEMENT NOT INCLUDE A CASH FLOW STATEMENT, VIOLATE NC LAW AND DOES NOT TIE TO 2015-2016 AND ARE TO A REVISED AND CONFUSING FORMAT????

6)WHY DO WE HAVE ANOTHER SHAM ELECTION, WITH 3 BOARD SLOTS AND ONLY 3 CANDIDATES????

7)WHY IS DR. OWENSBY STILL ALLOWED TO BE A BOARD MEMBER AFTER HIS PRESIDENCY WAS INVOLVED WITH COLLUSION WITH HORRACK TALLEY ATTORNEYS IN THE 2006 ILLEGAL $197,000.00 SPECIAL ASSESSMENT. (ATTACHMENT 2).

8)WHY HAS SECRETARY MATTHEW PETCHELL NOT POSTED 2016-2017 BOARD MEETING MINUTES OR HELD OPEN BOARD MEETINGS????

9)WHY HAS SECRETARY MATTHEW PETCHELL NOT POSTED THE ROYDEN DIRECTOR’S AND OFFICERS LIABILITY INSURANCE CLAIMS OVER THE PAST 3 YEARS AND THE LEGAL ACTION TAKEN AGAINST RINALDI FOR SANCTIONS AS REQUIRED BY THE COVENANTS, NOR TREASURER BEN PLEUNE NOTED THE $6,330.00 PAID TO THE RHA, IN THE ROYDEN FINANCIALS????

10)WHY ARE THERE NO ORBS ON THE EASEMENT HOLDERS PROPERTY AND WHY IS ROYDEN NOT PURSUING A MODERNIZATION OF THE FRONT ENTRANCES????

WHY DOES THE ROYDEN BOARD USE THE CONSOLIDATED COVENANTS CREATED IN 2004 AND SAVE LEGAL FEES FOR SOME UNDEFINED NEW LEGAL EXERCISE. (GOOGLE ROYDEN REVISED HOA COVENANTS AND IT WILL TAKE YOU TO OUR BLOG AND THE COVENANTS ARE THERE)

11)WHY HAVE PAST ATTEMPTS AT CHANGING THE ROYDEN BY-LAWS AND COVENANTS NOT FOLLOWED NC LAW AND THE REQUIREMENT OF ALL VOTING BY PHASE WITH A 2/3 REQUIREMENT, BY PHASE?????

13)WHY HAVE PAST CASH SHORTFALL ESTIMATED AT FROM AS LOW AS $4,000.00 TO AS HIGH AS AN ESTIMATED $20,000.00 NOT BEEN INVESTIGATED BY AN OUTSIDE ATTORNEY OR ACCOUNTANT???

13)WHY HAS FINANCIAL INFORMATION FROM 2012-2016 NOT BEEN PROVIDED ON THE WEBSITE OR TO MEMBERS AS REQUIRED BY NC LAW?????
14) WHY HAS THERE NOT BEEN AN ARCHITECTURAL REVIEW COMMITTEE FORMED INCLUDING MEMBERS WITH MINUTES AND VISIBILITY OF MEMBER APPROVALS AS REQUIRED BY THE COVENANTS????

15)WHY IS EMAIL BEING USED FOR INVOICING WHEN COVENANTS DICTATE USPS ONLY????

16)WHY IS THE RHA HOLDING OVER $30,000.00 IN CASH WHEN THERE HAS NEVER….YES NEVER BEEN A NEED TO USE THE CONTINGENCY RESERVE??? JUST LOOK AT LAST YEAR WHERE THE OPERATING BUDGET WAS OF BY OVER 50%??? JUST MORE MONEY TO WASTE ON LEGAL FEES!!! WITHOUT MEMBER APPROVALS!

Hopefully the recent Annual Meeting attendance is more than just Rinaldi and an adversarial Board…Last year they would not take his questions without a seconding?????? KC Brechnitz’s answer to Rinaldi’s question as to what was the Covenant the Boards Annual Assessment was based on???? His Answer….ALL OF THEM!!!!!….Really!!!!!!…”clueless!”

Good Luck Saturday!…We are pleased to know that our apathetic and indifferent Royden members are armed with the knowledge transferred to them via these newsletters, and will be able to ask penetrating questions?????? Wait…….Not so sure about that statement!!!!!

At some point, if the Royden Board persists in their “breach of fiduciary duty, constructive fraud” (By Owensby!!!!) we will get media attention on the issues that have caused “an elite Charlotte neighborhood, to become a rogue HOA”,.
Meanwhile, try googling any board members name and the word ROYDEN, and see what comes up. If anything, we will make these complicit rogue Board members famous!!! Or in our view…INFAMOUS!!!!!
